This Privacy Policy explains how Amberwake collects, uses, stores, and shares personal data when you visit amberwake.com, contact us, or use products and services we operate under the Amberwake brand.

This policy is an umbrella document for Amberwake-operated apps. A specific app may publish its own privacy supplement to describe product-specific features, data flows, or legal requirements. Where a product-specific supplement conflicts with this document for that product, the supplement will prevail for the conflicting topic.

Amberwake is operated by Mario Martinez. In this Privacy Policy, references to "Amberwake", "we", "us", and "our" refer to Amberwake and its operator, Mario Martinez.

Privacy inquiries: submit your request through the Amberwake contact channel and include "Privacy" in the subject or message so it can be routed appropriately.

Additional legal or organizational details may be provided on request where required by applicable law.

2. Scope

This policy applies to amberwake.com and to Amberwake-operated apps, websites, services, and communications that link to, reference, or incorporate this policy.

It does not apply to third-party websites, tools, or services that are not operated by Amberwake, even if they are linked from an Amberwake property.

The categories of data we collect depend on how you interact with us. On amberwake.com today, the data categories include the following.

  • Contact form data: name, email address, optional company name, and the contents of your message.
  • Anti-abuse and security data: IP address or similar network identifiers used for rate limiting, abuse prevention, request validation, and service protection.
  • reCAPTCHA verification data: token-based verification signals, score-based abuse signals, and related metadata processed through Google reCAPTCHA when the contact form is used.
  • Analytics and usage data: page views, navigation events, outgoing link interactions, and related usage signals processed through OpenPanel when analytics is enabled in the deployment.
  • Operational delivery data: timestamps, technical request metadata, and delivery logs associated with webhook or email handling of contact submissions.

4. How we use personal data

  • To operate and secure the Amberwake site and related services.
  • To receive, review, and respond to contact, press, partnership, or company inquiries.
  • To prevent spam, abuse, fraud, and unauthorized use.
  • To monitor service performance, understand site usage, and improve our public web experience.
  • To comply with legal obligations and protect our rights, users, products, and infrastructure.

6. Processors and third-party recipients

Amberwake may use service providers and infrastructure partners to operate the site and related communications. The providers currently reflected in the site codebase or runtime configuration include the following.

  • Cloudflare Pages and Cloudflare Functions for hosting, request handling, and edge delivery.
  • Google reCAPTCHA for spam and abuse prevention on the contact form.
  • OpenPanel for analytics when enabled.
  • Resend for delivery of contact-form emails when configured.
  • Webhook destinations configured by Amberwake for routing contact submissions.

7. Retention

We keep personal data only for as long as reasonably necessary for the purposes described in this policy, including security, communications handling, recordkeeping, and legal compliance.

Contact submissions may be retained for follow-up, business recordkeeping, and abuse prevention. Security and operational logs may be retained for a shorter or longer period depending on the purpose, system design, and legal requirements.

8. International transfers

Amberwake and its service providers may process data in countries other than your own. Where required, we will rely on appropriate safeguards for international transfers, such as contractual protections or another lawful transfer mechanism.

9. Your rights

Depending on your location, you may have rights to access, correct, delete, restrict, object to, or port your personal data, and to withdraw consent where processing is based on consent.

12. Product-specific privacy supplements

When that happens, the relevant app may publish a privacy supplement describing its unique processing activities, retention rules, processors, user controls, and other product-specific information.
